"Trial & Errors" The Trial of Gambit
Gambit gives in to go on trial as he and the two bounty hunters slip away from the rest of the X-Men. Meanwhile, Hank works on transforming the wreckage of the Shi'Ar ship into a land craft to take them across the Antarctic so they can make their way home. As they travel, both Rogue and Joseph have the same strange feeling as Joseph finds and raises an underground fortress from the ice fields. The X-Men cautiously enter as they are captured and confronted by the mastermind of their ordeal, Erik the Red. Erik is going to put Gambit on trial as Gambit's deepest held secret comes to light in the trial. The X-Men find out that Gambit worked for Sinister before joining the X-Men and that he was the one who brought together the team known as the Marauders. In essence, Gambit made it possible for the massacre of the Morlocks. This does not sit well with the X-Men and especially Rogue, even when Gambit tells them that he tried to stop them and even rescued a young morlock, Marrow, from the slaughter. But before a sentence can be passed, the X-Men escape the trial and the fortress, but all is not forgiven for Gambit. In the end, Erik the Red was once again a cover persona for the return of Magneto.
Also the return of the Real Magneto thought to have died in the Avalon crash and then came back as Joseph.
